Bill Must Be Rejected Entirely If It Conflicts with Shariah

If the Property Transfer Bill 2026, placed in Parliament, contains any provisions that conflict with Shariah and the Muslim inheritance system, the entire bill must be rejected. The Hiba law should be amended based on the advice of respected Islamic scholars, rather than introducing laws that contradict the Quran and Sunnah. The state must refrain from approving any law that goes against Islam.

Several Pirs, Islamic scholars and top leaders of Islamic parties made these remarks in statements, meetings and rallies yesterday, demanding amendments to the Property Transfer Bill and, if necessary, its complete rejection.

A nationwide protest programme will be held next Friday demanding the repeal of the bill, which they say conflicts with Shariah provisions. Islami Andolan Bangladesh will announce its programme at a press conference today. Top Islamic scholars are also expected to issue a strong warning at a roundtable discussion organised by the Iman-Aqidah Protection Committee at the National Press Club this afternoon.

Pir of Sarsina Darbar Sharif

Pir of Sarsina Darbar Sharif, Alhaj Hazrat Maulana Shah Abu Nasr Nesaruddin Ahmad Hossain, said in a statement yesterday that the government must refrain from enacting any law that conflicts with the religious beliefs of the people and the teachings of the Holy Quran and Sunnah.

He urged the government to consult recognised Islamic scholars before making laws and policy decisions. He also demanded that the ongoing Hiba law be reconsidered after taking the views of Islamic scholars and that necessary amendments be made.

He said decisions on matters related to Islamic Shariah would be more acceptable and beneficial to the people if they were taken based on consultations with recognised Islamic scholars and experts in Islamic law. He urged the authorities concerned to amend the ongoing Hiba law and make it consistent with the teachings of the Quran and Sunnah.

Pir of Fandauk Darbar Sharif

Pir of the historic Fandauk Darbar Sharif and Ameer of Bangladesh Anjuman-e-Khadimul Islam, Alhaj Maulana Mufti Syed Shah Sufi Saleh Ahmad Mamun Al-Hussain, said the recently passed Hiba law on the distribution of family property through wills is completely against Shariah.

In a statement, he said the law conflicts with the provisions of the Holy Quran. He said, “Pirs, mashaikhs, recognised Islamic spiritual centres, scholars and 90 to 95 percent of devout Muslims in this country will not accept any law that goes against the Quran and Sunnah.”

The Pir urged Prime Minister Tarique Rahman to immediately amend the Hiba law. He said, “The people of this country will not accept any law that goes against the Quran, Sunnah and Shariah.” He urged the current government to remain alert so that no law contrary to the Quran, Sunnah and Shariah is passed in Parliament in the future.

Bangladesh Khilafat Majlis

Bangladesh Khilafat Majlis has announced a nationwide protest march next Friday against the passage of the Property Transfer Bill 2026, which was introduced in the name of protecting parents. As part of the programme, Bangladesh Khilafat Majlis Dhaka Metropolitan will hold a protest march from the north gate of Baitul Mukarram after Friday prayers.

Ameer of Bangladesh Khilafat Majlis Maulana Mamunul Haque announced the programme at a joint meeting of the organisation held at its central office in Purana Paltan in the capital on Wednesday afternoon. He chaired the meeting, while Joint Secretary General Maulana Ataullah Amin conducted it.

At the meeting, Maulana Mamunul Haque said a bill had been passed in Parliament in the name of protecting parents that could put the Muslim inheritance system, faraid and, in particular, women’s rightful inheritance rights at risk. “We will not accept this bill. It must be repealed immediately,” he said.

He said the bill passed in Parliament must be reviewed again by Islamic scholars and legal experts specialising in Islamic law, faraid and property law. Necessary amendments should be made if required. “And if it contains any provisions that conflict with Shariah and the Muslim inheritance system, the entire bill must be repealed,” he said.

Addressing the President, he said, “Do not sign any bill that conflicts with the religious rights of the people and the Muslim inheritance system.” He warned that if any anti-Islamic bill receives state approval, it will create strong anger and dissatisfaction among the people of the country. “The government itself will have to bear responsibility for this,” he said.

He urged scholars, devout Muslims and people from all sections of society to participate peacefully in the protest march next Friday.
Bangladesh Nezam-e-Islam Party
Bangladesh Nezam-e-Islam Party has called for the opinions of leading and knowledgeable Islamic scholars, muftis and faqihs to thoroughly examine the Shariah aspects of the Transfer of Property (Amendment) Bill 2026.

The party’s Executive President Maulana A K M Ashraful Haque made the call at a meeting with Islamic scholars held at the party’s central office yesterday. Among others, the meeting was attended by party Secretary General Maulana Muminul Islam, Central Vice-President Maulana Mizanur Rahman, Maulana Abdus Sattar, Aminul Islam, Assistant Secretary General Mufti Kamrul Islam Bhuiyan, Organisation Secretary Maulana Anwar Hossain Ansari and former student leader Maulana Mizanur Rahman.

Maulana A K M Ashraful Haque further said every provision of any law related to the matter must be reviewed in light of Shariah and fiqh principles before it is enacted. He said the opinions and advice of the country’s leading and prudent scholars, muftis and faqihs should be sought to prevent confusion among the general public.
