Property Transfer Act Conflicts with Quran and Sunnah: Hefazat e Islam
Hefazat e Islam Bangladesh has demanded amendment of the Property Transfer (Amendment) Bill 2026, claiming it conflicts with the Quran and Sunnah. At the same time, the organization has expressed anger that the opinions of Islamic Sharia experts were not sought before passing the bill.
These remarks were made at an emergency meeting held in the capital on Sunday (September 13), presided over by Hefazat e Islam Bangladesh’s Ameer, Allama Shah Muhibbullah Babunagari. At the meeting, Hefazat leaders said that the recently passed new law on property transfer has created the risk of legal complications regarding Muslim Heba, or gift deeds.
They expressed concern and protest that the bill was passed hastily in the National Parliament without consulting Islamic Sharia experts. Hefazat claims that the Property Transfer (Amendment) Bill 2026 conflicts with the Quran and Sunnah. The meeting also opined that proper consultation with Alems, Ulama, Islamic law experts and jurists is necessary when enacting or amending any law related to the personal law and religious provisions of Muslim citizens.
At the meeting, recent remarks by the Law Minister and the Chief Whip were also condemned. Hefazat leaders said that instead of questioning whether those objecting to an issue have read the law, the Sharia based and legal basis of their objections should be examined. Hefazat leaders said it is the state’s responsibility to show due respect to the personal law of Muslim citizens and the Sharia compliant property distribution system.
They demanded reconsideration and necessary amendment of the disputed provisions to protect the Heba custom and the rights of Muslim heirs. Hefazat leaders said they will continue their protest against the bill through peaceful and lawful means. At the same time, they called on the government to reach an acceptable solution on the matter through discussion with Alems, Ulama and legal experts, rather than entering into any form of conflict.
