That Falls from Someone Else’s Tree

Question: Is it halal to pick up and eat fruits that have fallen from someone else’s tree? And if the tree is enclosed by a fence, would eating such fruit be haram?

Answer: It may be eaten if it appears that the owner has given permission. However, if various indications suggest that the owner also wants to preserve and protect the fallen fruit, then eating it is not permissible.
